I’ll be honest. When I first heard Judge McAfee’s ruling in the Fani Willis case, my initial thoughts were, “That gutless bastard. All he did was to kick the can down the road.”
Then I found out that the Trump legal team was left dead in the water. Unless the same judge actually gave Team Trump’s lawyers his official approval to move forward, nothing will happen. Yeah… fat chance of that happening.
To me, it certainly seemed that Judge McAfee’s political opponents also running for his particular elected judicial office wouldn’t be able to make hay over his passing the buck in regards to Fani Pack.
Just a guess, but I could only guess that Trump’s legal team filing an appeal would be little more than simply pro forma.
But as Gomer Pyle would say, “Surprise, surprise, surprise.”
Boy, was I wrong. My open apologies to Judge McAfee.
Some very interesting information just published by reporter Priscilla DeGregory of the New York Post (emphasis mine);
“Donald Trump won a legal victory in the Georgia election fraud case against him Wednesday, when a judge granted him the right to appeal his ruling allowing District Attorney Fani Willis to stay on the case.”
“Fulton County Judge Scott McAfee granted the former president’s motion seeking an immediate review by Georgia’s Court of Appeals of his bombshell ruling on Friday allowing the embattled DA to continue prosecuting the case, despite her affair with lead prosecutor Nathan Wade.”
“Trump and seven other co-defendants seeking to boot Willis did not have an automatic right to appeal before the start of a trial.”
“However, McAfee granted the rare measure, citing the importance of the case. The appeal also delays a trial from being scheduled, making it highly unlikely it would take place before the election in November.”
